In recent years, artificial intelligence has begun making a quiet but decisive entrance into courtrooms and legal offices worldwide. This is no longer science fiction: predictive algorithms are already being used to assess a defendant’s risk of reoffending, assist lawyers in legal research, and even suggest sentencing guidelines. This phenomenon raises a crucial question for our society: can we truly delegate decisions affecting people’s freedom and fundamental rights to a machine?
From Predictive Analysis to Assisted Decisions
Systems like COMPAS, used in several American states, analyze hundreds of variables to calculate the probability that an individual will reoffend. These scores influence decisions about bail, parole, and even sentencing. In Europe, countries like Estonia have experimented with using AI to resolve small claims disputes, while in China some courts use virtual assistants to support judges in drafting rulings.
The main advantage is evident: speed and efficiency. Judicial systems in many countries are overwhelmed by backlogs accumulated over years, and AI promises to lighten this burden by analyzing documents, precedents, and evidence in record time.
The Problem of Algorithmic Bias
However, numerous studies have shown that these systems are not neutral. A 2016 ProPublica investigation revealed that the COMPAS algorithm tended to incorrectly classify African American defendants as high risk for recidivism more frequently than white defendants under equal conditions. This happens because algorithms learn from historical data reflecting decades of systemic discrimination, thus perpetuating past injustices under a new, seemingly objective technological guise.

The concept of “human in the loop” becomes fundamental: a judge must be able to understand, critically evaluate, and, if necessary, deviate from algorithmic recommendations.
Future Challenges
The path toward fair integration of AI in justice is still long. Independent audits of algorithms, more representative training datasets, and specific training for legal professionals are needed. Only through a multidisciplinary approach involving jurists, computer scientists, sociologists, and ethicists will it be possible to harness the potential of artificial intelligence without sacrificing the fundamental principles of fairness and justice on which our democratic societies are built.
